BOOKING TERMS AND CONDITIONS

Company Name: THEE CURIOUS TRAVELLER TOURS LTD

Company Number: 11832859

Trading Names: Thee Curious Traveller Tours and Kokoro Atlas

Except where otherwise specified, we act as a travel organiser, agent or sub-agent in respect of bookings we take and/or make on your behalf.

These are the terms on which we arrange travel and holiday requirements. We curate and organise our own package holidays and may also arrange bookings with third-party suppliers, including accommodation providers, tour operators, transport providers and activity providers.

Where we organise a package holiday, your contract is with us and these Terms and Conditions apply. Where we act as an agent, we arrange for you to enter into a contract with the relevant supplier named on your booking confirmation.

Where we act as an agent, the supplier’s Terms and Conditions will also apply. We advise you to read these carefully.

Where we organise our own package holidays using third-party suppliers, we remain responsible for the proper performance of the package in accordance with applicable package travel legislation.

These Terms and Conditions are governed by English law and the jurisdiction of the English courts.

1. Booking and Payment

When you make a booking, you guarantee that you have the authority to accept these booking conditions on behalf of your party.

To confirm your chosen arrangements, you must pay the required deposit or full payment where requested at the time of booking. You must also pay any applicable insurance premiums and booking fees.

Your booking is confirmed when we issue written confirmation.

Please check your confirmation carefully and report any incorrect or incomplete information immediately. Please ensure that all traveller names match their passports.

Any changes to booking details may incur charges determined by the applicable booking conditions.

All bookings are non-refundable. This includes deposits, instalments and full payments made towards a booking.

The booking information you provide will be passed to relevant travel suppliers and other parties where necessary to provide your travel arrangements or where required by law. Personal information will be handled in accordance with applicable data protection legislation.

If you have paid a deposit, you must pay the full balance by the notified due date.

If the balance remains outstanding seven days after the notified due date, we reserve the right to add a late payment fee of £30.

If full payment is not received by the required date, we may cancel your booking and apply the relevant cancellation charges.

Where we act as an agent, monies received may be held on behalf of the relevant supplier, subject to the applicable financial protection arrangements.

2. Accuracy of Prices

We reserve the right to amend advertised prices at any time before a booking is confirmed.

We also reserve the right to correct errors in advertised prices.

Changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking.

Any changes to confirmed package holiday prices will be subject to applicable package travel legislation.

3. Insurance

We strongly advise you to take out comprehensive travel insurance to cover you and your party against the cost of cancellation by you, medical emergencies, repatriation, loss of baggage and money, and other unforeseen expenses.

Some suppliers may require travel insurance as a condition of booking.

Please ensure that your insurance policy provides appropriate cover for your destination, activities and personal circumstances, including any pre-existing medical conditions.

Failure to disclose relevant information may affect your insurance cover.

4. Special Requests

If you have any special requests, including dietary requirements, accessibility needs or accommodation preferences, please let us know at the time of booking.

We will make reasonable efforts to accommodate requests or pass them to the relevant suppliers.

However, special requests cannot be guaranteed unless expressly confirmed as part of your booking.

5. Changes and Cancellations

Changes and Cancellations by You

Any cancellation or amendment request must be made by the lead traveller and sent to us in writing by email or post.

Cancellation requests will take effect on the date they are received.

Please ensure that you receive written confirmation of any changes before travelling.

Nothing in these Terms and Conditions affects rights that cannot be excluded by law.

All bookings are non-refundable upon cancellation by the customer, including deposits, instalments and full payments.

Whilst we will try to assist with amendments, we cannot guarantee that requests will be accepted.

Any approved amendments may be subject to additional charges.

Changes and Cancellations by Us or the Supplier

We will inform you as soon as reasonably possible if a confirmed booking needs to be significantly changed or cancelled.

Where we act as an agent, we will liaise with the relevant supplier regarding any alternative arrangements or refunds available under their booking conditions.

Where we are the package organiser, we will arrange alternatives or refunds where required.

6. Our Responsibility for Your Booking

Where we organise and sell our own package holidays, we are responsible for the proper performance of the travel services included in the package in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018.

Where we act solely as an agent, your contract is with the relevant supplier and their booking conditions apply.

In those circumstances, our responsibilities are limited to making the booking in accordance with your instructions and exercising reasonable care and skill.

We do not exclude or limit any liability for death or personal injury arising from our negligence or that of our employees, or any other liability that cannot legally be excluded.

7. Financial Protection

All package holidays sold or organised by us will be provided with the financial protection required by applicable law.

Where we organise a package holiday, we are responsible for ensuring that the appropriate insolvency protection arrangements are in place.

Where we sell a package organised by another tour operator, the relevant organiser will be responsible for providing the required package protection.

Where separate travel services are purchased, the financial protection applicable will depend on whether the arrangements constitute a package holiday, linked travel arrangement or individual travel service.

A) When We Sell Face to Face

Where you purchase separate travel services that do not constitute a package holiday, the relevant service providers will be responsible for performing their individual services.

Where the arrangements constitute a linked travel arrangement, the applicable protections under the Package Travel and Linked Travel Arrangements Regulations 2018 will apply.

B) When Booking Online

Where you purchase travel services through our website, the applicable package holiday or linked travel arrangement protections will depend on how those services are selected, combined and purchased.

Where we organise a package holiday, the relevant package travel rights will apply.

C) When We Send Links to Other Websites

Where we provide links to third-party websites for additional travel services, the applicable legal protections will depend on whether the bookings form part of a package holiday, linked travel arrangement or separate booking.

Where a linked travel arrangement is created, the relevant insolvency protection requirements will apply.

A copy of the Package Travel and Linked Travel Arrangements Regulations 2018 can be found at: https://www.legislation.gov.uk/uksi/2018/634/contents

8. Passport, Visa and Health Requirements

We can provide general information about passport, visa and health requirements for your trip.

Your specific passport, visa and immigration requirements are your responsibility, and you should confirm these with the relevant embassies, consulates or government authorities.

Neither we nor the relevant suppliers accept responsibility where you cannot travel because you have failed to comply with applicable passport, visa or immigration requirements.

Please note that requirements may change between booking and departure.

We can provide general information about health formalities, but you should consult your doctor or an appropriate healthcare professional regarding your personal circumstances in good time before departure.

9. Accommodation Ratings, Standards and Information

All accommodation ratings are provided by the relevant suppliers and are intended as a guide to the services and facilities you should expect.

Standards and ratings may vary between countries and suppliers.

Descriptions and content on our website or in promotional materials are intended to provide a general overview of the services offered.

All services are subject to availability.

If you require further details about accommodation or other travel services, please contact us before booking.

10. Complaints

If you experience a problem whilst on holiday, you must report it to us or the relevant supplier as soon as reasonably possible so that the issue can be investigated and addressed.

Where we organise your package holiday, we will handle complaints in accordance with our obligations as the package organiser.

Where we act as an agent, we will assist in communicating complaints to the relevant supplier.

If you wish to complain after returning home, please contact us in writing using the contact details provided in your booking confirmation.

11. Final Travel Arrangements

Please ensure that all travel, passport, visa and insurance documents are in order before departure.

Where applicable, you must arrive at the designated meeting point or departure location in sufficient time for your scheduled arrangements.

Failure to comply with travel requirements may result in loss of travel services.

12. Delivery of Documents

Travel documents, including invoices, booking confirmations, vouchers and insurance policies, may be sent electronically or by post.

Documents requiring postal delivery will usually be sent via Royal Mail.

Once documents leave our offices, we will not be responsible for their loss unless it is due to our negligence.

If documents need to be reissued, any applicable replacement costs may be charged to you.
